In these Terms and Conditions, the following definitions apply:

- "Products" — refers to all outboard motors, inboard engines, marine generators, parts, accessories, and related items offered for sale on our website or through direct enquiry.
- "Services" — refers to engine repairs, overhauls, routine maintenance, technical consultations, installations, and any other services we provide.
- "Order" — refers to a binding request to purchase Products or Services from us, whether placed through our website, by email, by telephone, or in person.
- "Agreement" — refers to the contract formed between you and us when you place an Order that we accept.
2. General Provisions
2.1 These Terms and Conditions apply to all offers, quotations, Orders, deliveries, and agreements between Green Boat Engines and you, unless expressly agreed otherwise in writing.
2.2 These Terms supersede any previous terms and conditions and override any terms you may seek to impose, unless we have explicitly accepted your terms in writing.
2.3 We reserve the right to amend these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after such changes constitutes acceptance of the revised Terms.
2.4 If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
2.5 Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
2.6 These Terms are available in English. In the event of any discrepancy between translations, the English version shall prevail.
3. Website Use
3.1 You must be at least 18 years of age to place an Order or create an account on our website. By using our website, you represent and warrant that you meet this requirement.
3.2 You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website.
3.3 You are responsible for ensuring that all information you provide to us — including contact details, delivery addresses, and payment information — is accurate, complete, and up to date.
3.4 We make reasonable efforts to ensure that the information on our website is accurate and up to date. However, we do not warrant that product descriptions, specifications, prices, or availability are error-free. In the event of an obvious error (e.g., a manifestly incorrect price), we reserve the right to cancel or amend the Order.
3.5 Product images on our website are for illustrative purposes only. Actual products may vary slightly in appearance, colour, or finish due to manufacturer updates, lighting conditions, or screen display settings.
3.6 We reserve the right to suspend, restrict, or terminate your access to our website at any time, without notice, if we believe you have violated these Terms or applicable law.
4. Quotations and Pricing
4.1 All prices displayed on our website are in Euros (€) unless otherwise stated, and include VAT at the applicable Dutch rate unless explicitly indicated as ex-VAT.
4.2 Prices are subject to change without prior notice. The price applicable to your Order is the price displayed at the time you place your Order.
4.3 Quotations provided by email, telephone, or in writing are valid for the period stated in the quotation, or if no period is stated, for 14 calendar days from the date of issue.
4.4 A quotation does not constitute an offer and may be withdrawn or revised by us at any time before acceptance.
4.5 Additional costs — such as shipping, handling, customs duties, import taxes, and installation fees — are not included in the product price unless expressly stated. These will be itemised separately in your quotation or Order confirmation.
4.6 For international Orders outside the European Union, you are responsible for all applicable import duties, taxes, and customs clearance fees in your destination country.
5. Orders and Contract Formation
5.1 To place an Order, you may:
- Add products to your cart and complete the checkout process on our website
- Submit an enquiry or request a quotation via our contact form or email
- Contact us by telephone to discuss your requirements and confirm an Order
5.2 All Orders are subject to acceptance by us. An Order is not binding until we issue an Order confirmation (by email or otherwise).
5.3 We reserve the right to refuse or cancel any Order for reasons including but not limited to:
- Product unavailability or discontinuation by the manufacturer
- Errors in product descriptions, pricing, or availability
- Suspected fraud, unauthorised payment, or violation of these Terms
- Export restrictions or regulatory compliance issues
- Failure to provide required documentation (e.g., import licences, VAT numbers)
5.4 If we cancel your Order after payment has been processed, we will refund the full amount paid within 14 business days using the original payment method.
5.5 You may not cancel or amend an Order after Order confirmation without our written consent. If we agree to a cancellation or amendment, we may charge a reasonable restocking or administrative fee.
6. Payment Terms
6.1 Payment must be made in full before dispatch of Products or commencement of Services, unless we have agreed alternative payment terms in writing (e.g., partial deposit with balance due on delivery).
6.2 We accept the following payment methods:
- Bank transfer (SEPA / international wire transfer)
- Credit and debit cards (Visa, Mastercard, American Express)
- PayPal
- Other methods as agreed in writing
6.3 For bank transfers, you are responsible for all bank charges and intermediary fees. The full invoice amount must be received in our account.
6.4 For large or custom Orders, we may require a non-refundable deposit (typically 30–50% of the Order value) before processing. The deposit amount and terms will be specified in your quotation or Order confirmation.
6.5 If payment is not received within the agreed timeframe, we reserve the right to:
- Suspend or cancel your Order
- Charge statutory interest on overdue amounts at the rate prescribed by Dutch law (Wet op de consumentenkrediet)
- Recover collection costs in accordance with the Dutch Collection Costs Act (Wet incassokosten)
6.6 All payments are processed securely. We do not store full credit card details on our servers. Payment processing is handled by PCI-DSS compliant third-party providers.
7. Delivery and Shipping
7.1 We deliver to addresses within the Netherlands, the European Union, and worldwide, subject to applicable export regulations and carrier availability.
7.2 Delivery times are estimates only and commence from the date of Order confirmation and cleared payment, not from the date the Order is placed. Typical delivery times are:

7.3 Delivery times may be affected by factors beyond our control, including manufacturer lead times, customs clearance, weather conditions, carrier delays, and public holidays.
7.4 Risk in the Products passes to you upon delivery to the carrier for shipment. Title to the Products remains with us until full payment has been received.
7.5 You must inspect the Products upon delivery and notify us of any visible damage, defects, or discrepancies within 48 hours of receipt. Failure to do so may affect your right to claim under our Returns Policy.
7.6 If delivery is refused or fails due to incorrect address details provided by you, or if you fail to collect the Products from a designated pickup point within the carrier's holding period, we reserve the right to charge additional shipping fees or restocking fees, or to treat the Order as cancelled.
7.7 For large or heavy items (e.g., outboard motors, inboard engines), delivery may be arranged via freight carrier or specialised marine logistics. Specific delivery arrangements will be coordinated with you after Order confirmation.
8. Returns, Refunds, and Cancellations
8.1 Our Returns and Refunds Policy is set out in full on our Refund & Returns Policy page and is incorporated into these Terms by reference.
8.2 For consumers within the European Union, you have a statutory right to cancel your Order within 14 days of receiving the Products (the "cooling-off period"), subject to certain exceptions for custom-made, personalised, or perishable goods.
8.3 For outboard motors and marine engines, we offer an extended return period of 60 days from the date of delivery, provided the Products are unused, in original packaging, and in resalable condition. This is in addition to your statutory rights.
8.4 To initiate a return, you must contact us at help@greenboatengines.nl or via our Contact Us page to obtain a Return Merchandise Authorisation (RMA) number. Returns without an RMA number may be refused.
8.5 Refunds will be processed within 14 business days of receiving and inspecting the returned Products. Refunds will be issued to the original payment method.
8.6 Return shipping costs are the responsibility of the customer unless the Products are defective, damaged, or incorrectly supplied by us.
8.7 Custom Orders, special orders, and items that have been modified, installed, or used cannot be returned unless defective. Marine engines that have been run, fluids added, or propellers fitted are considered used.
9. Warranty
9.1 All new Products sold by Green Boat Engines are covered by the manufacturer's standard warranty, which varies by brand and product type. Warranty details are provided with the Product or available upon request.
9.2 Reconditioned or refurbished engines and parts are covered by our own limited warranty, typically 6 to 12 months from the date of delivery, unless otherwise stated. The specific warranty period and terms will be provided at the time of sale.
9.3 Our warranty covers defects in materials and workmanship under normal use and maintenance. It does not cover:
- Damage caused by improper installation, operation, or maintenance
- Damage caused by accidents, collisions, submersion, or environmental factors
- Normal wear and tear, including propeller damage, anode depletion, and seal degradation
- Use of non-genuine or incompatible parts or fluids
- Modifications or repairs carried out by unauthorised persons
- Damage caused by contaminated or incorrect fuel, oil, or coolant
- Commercial or racing use beyond the Product's rated capacity
9.4 To make a warranty claim, you must notify us in writing within the warranty period, providing proof of purchase, a description of the defect, and photographs or videos where applicable.
9.5 Our sole obligation under warranty is, at our discretion, to repair, replace, or refund the defective Product. We are not liable for consequential damages, loss of use, or third-party claims arising from a defect.
9.6 Nothing in this clause affects your statutory rights as a consumer under Dutch or EU law.
10. Services, Repairs, and Installation
10.1 All Services are subject to a separate quotation or work order, which will specify the scope of work, estimated labour hours, parts required, and total cost.
10.2 Quotations for Services are estimates based on visible inspection and standard procedures. If additional work is required due to hidden damage, corrosion, or wear discovered during service, we will notify you and obtain your approval before proceeding.
10.3 You are responsible for ensuring that your vessel or equipment is accessible and prepared for service at the agreed time and location. Delays caused by your failure to provide access may result in additional charges.
10.4 We recommend that all engine installations, major repairs, and overhauls be carried out by qualified marine technicians. If you choose to install or repair Products yourself, we are not liable for damage caused by improper installation.
10.5 For on-site or mobile services, travel time, fuel, and accommodation costs (where applicable) may be charged in addition to labour and parts.
10.6 We reserve the right to refuse service to vessels or equipment that we deem unsafe, unseaworthy, or in violation of applicable regulations.
11. Limitation of Liability
11.1 To the fullest extent permitted by law, Green Boat Engines shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of use, or damage to reputation, arising out of or in connection with your use of our website, Products, or Services.
11.2 Our total liability to you for any claim arising out of or relating to these Terms, our website, Products, or Services shall not exceed the total amount paid by you for the specific Product or Service giving rise to the claim.
11.3 Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any matter for which it would be unlawful for us to exclude or limit liability
11.4 You agree to indemnify and hold harmless Green Boat Engines, our directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of our Products or Services, or your violation of any law or third-party rights.
12. Intellectual Property
12.1 All content on our website — including text, images, logos, videos, software, and design — is the property of Green Boat Engines or our licensors and is protected by copyright, trademark, and other intellectual property laws.

12.3 All third-party trademarks appearing on our website are the property of their respective owners. Their use does not imply endorsement or affiliation.

14.2 We reserve the right to refuse Orders destined for countries or persons subject to EU, UN, or other applicable sanctions.
14.3 You warrant that you will not use our Products for any unlawful purpose, including but not limited to military, paramilitary, or terrorist activities, or in violation of human rights.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.
15.2 Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Amsterdam, The Netherlands, and you hereby consent to the personal jurisdiction and venue of such courts.
15.3 For consumers within the European Union, nothing in these Terms affects your mandatory statutory rights under EU consumer protection law, including the right to bring proceedings in your country of residence.
16. Dispute Resolution
16.1 In the event of a dispute, we encourage you to contact us first at help@greenboatengines.nl to seek an amicable resolution.
16.2 If we cannot resolve the dispute informally, EU consumers have the right to use the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/odr.
16.3 We are not obligated to participate in alternative dispute resolution (ADR) procedures before a consumer dispute resolution body, but we may choose to do so at our discretion.
